Last Friday, the D.C. Circuit Court of Appeals ruled in favor of the 2000 Department of Defense appropriations act, which allows the DOD to sign contracts with Native American businesses without subjecting them to the usual bidding wars. The court’s decision was based on Supreme Court rulings drawing a distinction between Native and racial classifications.
