A recent ruling by the High Court in the Mariuwung Gajjerong native title case found that native title can exist alongside pastoral and mining leases, but that native title does not encompass subsurface minerals and petroleum. The ruling means that native title has been extinguished over the Argyle Diamond mine. The High Court will refer elements of the case back to the Federal Court.
