UNITED STATES: Court exempts New York tribe’s land from state jurisdiction

On Monday, July 21, the Second Circuit Court of Appeals upheld a lower court’s ruling to exempt the Oneida Nation of New York’s land from state jurisdiction. The court said that the 1794 Treaty of Canandaigua creating the Oneida Reservation remains in effect whether or not the tribe existed continuously as an organized body throughout the years. The Oneida of New York are one of several tribes seeking to reestablish rights in the state.
