CANADA: First Nations want new Supreme Court ruling on land claim

After losing their land claim case against the federal government last December, the Cape Mudge and Campbell River bands are now asking the Supreme Court of Canada to overturn its decision, citing a potential conflict of interest. The bands say that the ruling is unfair because its author, Justice Ian Binnie, was involved in the defense of the case when it first surfaced eighteen years ago. Though Binnie claims to have no recollection of his past involvement in the case, the bands’ lawyer insists that the court’s decision was biased.
